A class action lawsuit has been filed against Sony for the PlayStation 5—specifically the DualSense controller that it comes with.
According to IGN, a US law firm in Virginia named Chimicles Schwartz Kriner & Donaldson-Smith LLP (CSK&D) has filed a suit against Sony alleging that the company was aware of the controller drift problem with the DualSense controller but didn’t disclose it to the masses when they launched the PS5. What’s more, they claim that the company has limited options to repair or replace a defective controller, with users having to jump through several hoops just to get Sony’s attention; and even then, their controllers don’t end up being fixed.
To those unawares, the “controller drift” is described in the lawsuit as a defect "that results in characters or gameplay moving on the screen without user command or manual operation of the joystick.”
The issue is said not to be unique to Sony as users of the Nintendo Switch had also brought up problems with controller drift with the joy-con online—a fact that the firm has also brought forward.
The firm wants to reach a jury trial plus “monetary relief for damages suffered, declaratory relief, and public injunctive relief,” on Sony’s part. Sony has yet to make any comment on the lawsuit, but users are definitely intent to see how they respond. With the PS5 already attached to the problem with ‘scalpers’, a lawsuit about the DualSense controller is the last thing that Sony needs on its plate.
For now, the PlayStation 5 is still available for purchase… if you can find one that is.
